According to the announcement, HSN 8741 all-in-one PCs, laptops, tablets and servers will be “restricted”. Their importation will be permitted if there is a valid license applicable for the purpose of import restriction.

Interestingly, an exemption from the import licensing requirement has been applied to the import of a tablet, laptop, microcomputer or all-in-one personal computer. This also includes products purchased from e-commerce portals through courier or post office. Imports will also come with the payment of taxes if applicable.

Exemptions have also been imposed on tablets, microcomputers, all-in-one PCs and laptops for import licensing needs where they form a significant part of the capital goods.

For R&D testing and repair evaluation, the government provides an exemption from import permits for the import of up to 20 items per shipment. However, this exemption depends on the fact that such imports will not be allowed to be sold but only for the use for the purpose mentioned. “Furthermore, after the intended purpose, the products will be destroyed unusable or re-exported,” the notice said.

The Notice also states that an import restriction permit is not required in the case of repair and return of repaired goods abroad for repair and re-import in accordance with the Foreign Trade Policy.

The reason behind the restrictions

The restrictions are seen as a direct enhancement of the IT Hardware Center’s recently revamped Manufacturing Associate Incentive (PLI) program. According to a senior government official, the measure will spur companies to produce according to local demand in India, as the country is moving towards increasing domestic production in the sector.
