What is the Health Bill of Rights?
The Rajasthan Right to Health Bill was introduced in the Rajasthan Assembly in 2022. This Bill aims to make provisions to ensure security and satisfaction of equal right to health and well-being for all individual. Simply put, if a patient cannot pay for emergency, stabilization or referral care, the government will reimburse the healthcare provider.
The main features of the Health Bill of Rights are:
- The bill grants residents of the state the right to health care as well as access to health care services. This involves providing the people of the state with free medical services at any medical facility.
- The bill requires state governments to uphold the right to health and maintain public health.
- At both the state and district levels, health authorities will be established. These organizations will create and implement systems for managing public health emergencies and providing high-quality health care.

What does the Health Bill of Rights provide?
- Right to health: Everyone will have access to free indoor and outdoor patient wards, medicines, testing at public health facilities and emergency care and treatment at all including health care providers without prior payment or police approval.
- Additional rights for residents: Ordinary residents of Rajasthan will have certain additional rights to avail free health care services from any medical facility and for transportation and treatment and free insurance against road traffic accidents at all healthcare facilities.
- State government obligations: The state government shall develop and regulate a public health model, make appropriate provisions in the state budget and make available health care services taking into account distance, geographical area or population density. Personnel policies will also be formulated and legitimized by the government to ensure equitable distribution of healthcare professionals.
- Health Authorities: At the state and district levels, separate organizations called State Health Authorities (SHA) and District Health Authorities (DHA) will be established. These agencies will develop, implement, and monitor systems for managing public health emergencies and delivering high-quality health care.
- Complaint resolution: The law provides a process for resolving complaints about denial of services and violations of rights. To submit concerns, a 24-hour helpline and support website will be developed. Agencies including Local Health Authorities and State Health Authorities will be involved in unresolved complaints.
Why are doctors protesting against the Rajasthan Health Rights Bill?
A large number of doctors took to the streets and called for a strike to express their dissatisfaction with the new bill. Private healthcare providers have criticized the law, saying it ignores advice from medical experts, lacks preparation and does not take into account the on-the-ground realities of the system.
Additionally, protesting doctors believe the law overregulates the medical industry, as there have been many other bills facilitating free medical services. They view implementation of the bill as an unrealistic approach to healthcare and a potential burden on private hospitals.
